GENERAL TERMS & CONDITIONS

1. General Terms
These General Terms & Conditions are concluded on the one hand by the company Sous Vide Consulting UG located at Gutenbergstr. 10, 73760 Ostfildern, Germany hereinafter referred to as "SVC" and, on the other hand, by any natural or legal person making a purchase via the website of Sous Vide Consulting UG hereinafter referred to as "the Buyer" or "Buyer ". These conditions of sale aim to define the contractual relationship between SVC and the Buyer and the conditions applicable to any purchase made through the SVC merchant site.

2. Conclusion of the Contract
2.1 The offers in the online shop constitute a non-binding invitation to the customer to order goods in the online shop.
2.2 By placing an order for the desired goods in the online shop, the customer submits a binding offer to conclude a sales contract.
2.3 SVC is entitled to accept this offer within 4 business days by sending an order confirmation to the customer. The order confirmation is carried out through a written confirmation by E-Mail. If no order confirmation has been sent after the 4 days period has expired, the offer can be regarded as rejected.

3. Shipment
3.1 All items, if on stock, will be shipped immediately, Shipment is available worldwide.
3.2 Unless otherwise specified, the delivery time is 5 days maximum for Germany. For other countries of the European Union, the deadline is, unless otherwise specified, a maximum of 15 days. These delivery times are given for information only. Under no circumstances can SVC be held responsible in the event of failure of a carrier, in particular in the event of an accidental or force majeure event.
3.3 In the event that a product is out of stock, we will inform you by e-mail about the waiting period.

4. Handling and Shipment Fees
4.1 SVC charges the amount of DHL or DPD shipping costs which you can view at www.DHL.de and www.DPD.com/de/en
4.2 Express deliveries are available on request. Additional costs associated with this type of delivery will be borne by the Buyer.

5. Payment
5.1 All prices are final and include VAT of currently 19%.
5.2 The payment options are as follows:

1. Bank transfer, (the Buyer agrees to transfer the amount of the order immediately after having validated his order on the SVC site). If you choose this method of payment we will send you our bank details by email. In order for the transfer to be processed quickly by the SVC accounting department, we recommend that you indicate the number of your invoice or order as well as the name of the purchaser when making the transfer.
2. PayPal, the Buyer must pay for their order through our Paypal account immediately after placing an order on the site www.sousvideconsulting.com.
3. By credit card via STRIPE.

5.3 The delivered goods will remain the property of SVC until the Buyer has fulfilled all his obligations towards SVC and, in particular, until full payment of the price (Eigentumsvorbehalt see §§158, 449 BGB).

6. Right of withdrawal
6.1 You have the option of canceling your order by mail or E-mail for a period of 2 weeks from the date of receipt of your order and acceptance of these General Terms & Conditions. In the event of an order involving several deliveries of identical goods, then the two-week period will begin from the day of the first delivery and the acceptance of these GTC. These GTC comply with the German legal provisions §312c Abs. 2 BGB in combination with §1 Abs. 2, 3 and 4 BGB-InfoV as well as SVC's obligation to inform the Purchaser according to the provisions §312e Abs. 1 Satz 1 BGB in conjunction with §3 BGB-InfoV. 6.2 The application of the right of withdrawal by the Buyer implies full refund of the goods by SVC on the condition that these goods are returned in excellent condition, in their original packaging and sealed. Within the framework of the right of withdrawal, the goods are, during transport, the property of SVC. The shipping back costs will be borne by the Buyer. SVC undertakes to reimburse the goods within 30 days of receipt by SVC of the letter or e-mail from the Purchaser invoking his right of withdrawal.
For reasons of hygiene and food safety in general, the cooking pouches cannot be returned or exchanged.

7. Warranty
In the event of apparent damage to the package and / or the merchandise upon receipt, it is the Buyer's responsibility to immediately file a complaint with the carrier and SVC. SVC cannot be held responsible for any damage during the transport of goods. In the event of damage not apparent at the time of delivery of the goods, the Purchaser must immediately inform SVC by mail or E-mail within 2 days of the date of delivery. SVC is not responsible for any damage resulting from the improper use of SVC's products or services, their wear and tear, or the action of a third party. Any interventions on products sold by SVC (in order to repair them) by the Purchaser, or carried out by third parties on behalf of the Purchaser without the express authorization of SVC and the manufacturer will result in the forfeiture of the warranty of the product concerned.

8. Limitation of liability
SVC cannot be held responsible in the following cases: SVC declines all responsibility in the event of an insubstantial difference between the photo, the description of the product or the technical sheet as published on the SVC website, and the essential characteristics of the product. SVC cannot be held responsible when the breach of its contractual obligations results from a fortuitous event or a case of force majeure. SVC cannot be held liable for any consequential or non-consequential non-material damage to the use of products sold through SVC such as: financial damage resulting from loss of profit, loss of business, loss of data, loss of opportunity. The limitations of liability listed above apply to SVC as well as to its employees, representatives or agents. The limitations of liability listed above are not valid when the damage results from gross negligence, bodily injury or defective products within the meaning of German Produkthaftungsgesetz law. In the event of defective merchandise, the return of the merchandise must be carried out by the Buyer with due diligence and in accordance with the terms of the Law. In the event of damage to the goods resulting from the Buyer's negligence or the terms of the law, SVC may make a claim within 2 years from the date of dispatch of the goods.

9. Personal data
The information related to the Buyer are used only for the sole purpose of carrying out the Buyer's order. The transmission of this information to third parties can only be done in this context (example: to the carrier of the goods). During the online sales process, the Buyer's order is secure and encrypted. SVC is only bound by an obligation of means and cannot be held responsible for any damage resulting from the use of the Internet network such as loss of data, intrusion, virus, interruption of service, unsolicited messages from other companies, or other unintended problems. Buyers' access codes to the customer account must be scrupulously kept by Buyers and kept secret from third parties. SVC accepts no responsibility for any fraud related to the use of these codes.

10. Intellectual property
All elements of the SVC site and publications are and remain the intellectual and exclusive property of SVC. In particular, this retention of title clause concerns images, logos, texts, animations (videos), scripts, part of software and other specific elements subject to copyright and connexed rights, associated with editing and distribution. All the elements listed above may not be copied, downloaded or modified without the express written permission of SVC. Any use in a hypertext link of the SVC logo, its brand, its graphics, or figurative or semi-figurative elements allowing SVC to be identified, requires the express written authorization of SVC.

11. Other topics
SVC is dependent on changes its suppliers may make to a product or suppliers inventory that could runs out. In this case SVC will contact you and offer you, if necessary, a similar product. SVC cannot be held responsible for the unavailability of an item from one of its suppliers. SVC reserves the right to modify its price list at any time.

12. Hypertext link on our site
The judgment of May 12, 1998 - 312 O 85/98 - "Haftung für Links" of the Hamburg court (LG Hamburg) indicates that a hypertext link on the SVC site to another site may imply a partial liability of SVC in because of its content. Also, SVC wishing to totally exclude this responsibility, and in accordance with the judgment of May 12, 1998, expressly declares to dissociate itself from the content of these sites.

13. Packaging and regulations
In order to comply with the regulations on packaging recycling (§ 6 VerpackV) the packaging and packaging of SVC products is part of the Landebell AG Mainz recycling program (customer number: 4137919). For more information we invite you to consult the website of Landbell AG.

14. Validity of the General Terms & Conditions of Sale and settlement of disputes
The acquisition of a good or a service implies unreserved acceptance by the Purchaser of these General Terms & Conditions. These conditions of sale will prevail over any other general or specific conditions not expressly approved by SVC. SVC reserves the right to modify its conditions of sale at any time, without notice. In this case, the applicable conditions will be those published on the date of the order by the Purchaser. These conditions of online sale are subject to German law. In the event of a dispute, the jurisdiction of the courts will be, unless otherwise agreed, Ostfildern in Germany.
